Terms of Service

Please note: Trafficly's services are intended exclusively for businesses (B2B). Trafficly does not provide services to consumers within the meaning of Article 22¹ of the Polish Civil Code.
§ 1. Definitions
For the purposes of these Terms of Service, the following terms have the meanings set out below:
- Service Provider – Tymoteusz Majchrzak, operating a sole proprietorship under the name Trafficly, ul. Reymonta 7, Podkowa Leśna, Poland, Tax ID (NIP): 5291870517, REGON: 545265239, e-mail: trafficly.kontakt@gmail.com, operating the Service at trafficly.pl.
- User – a natural person conducting business activity, a legal person, or an organizational unit without legal personality that has entered into a service agreement with the Service Provider.
- Service – the SaaS platform available at app.trafficly.pl, enabling use of Trafficly's services.
- Account – a User's individual account within the Service, secured with a login and password.
- Subscription – a paid, recurring service granting access to the Service's features, billed monthly or annually.
- Plan – the Subscription tier selected by the User, defining the scope of available features.
- Client Panel – the interface available after logging in, used to manage SEO strategy.
- AI Content – materials (articles, descriptions, texts) generated automatically by artificial intelligence systems at the User's request.
- Terms – this document.
§ 2. General provisions
- These Terms set out the rules and conditions for the electronic provision of services by the Service Provider through the Service.
- Use of the Service is possible after accepting these Terms and the Privacy Policy.
- The Service's services are intended exclusively for businesses (B2B) within the meaning of Article 43¹ of the Polish Civil Code.
- Using the Service requires an active e-mail address and a device with internet access.
- The Service Provider reserves the right to amend these Terms, subject to a 14-day notice period sent to Users by e-mail.
§ 3. Registration and Account
- Registering for the Service is free and requires providing an e-mail address and creating a password.
- The User is obliged to provide true and up-to-date information.
- The User bears full responsibility for the security of their login credentials. Sharing access credentials with third parties is prohibited.
- One account is assigned to one entity. Creating multiple accounts for the same entity in order to circumvent Plan limits is not permitted.
- The Service Provider may suspend or delete an Account in the event of a breach of these Terms, after first notifying the User by e-mail.
§ 4. Subscription Plans and Payments
- The Service offers the following Subscription Plans (current prices and scope available at trafficly.pl/cennik):
- Starter Plan – basic access to SEO tools
- Growth Plan – expanded content generation and monitoring
- Scale Plan – advanced features, multi-domain support
- Pro Plan – full access, unlimited capabilities
- Payments are processed via Stripe (Stripe, Inc.). Trafficly does not store payment card data.
- The Subscription renews automatically for the next billing period unless the User cancels it before the renewal date.
- In the event of a failed payment, the Service Provider will make up to 3 attempts to collect payment within 7 days; if unsuccessful, access may be suspended.
- A VAT invoice is issued for every payment and sent to the provided e-mail address.
- Prices listed in the Service are net prices and do not include VAT.
- The Service Provider reserves the right to change pricing with 30 days' notice. Price changes do not affect the current billing period.
§ 5. Scope of Services
As part of a Subscription, the Service Provider provides the following services (scope depends on the selected Plan):
- SEO content generation – automatic creation of articles, descriptions, and other texts optimized for search rankings using artificial intelligence systems.
- WordPress auto-publishing – integration with the WordPress platform enabling automatic publication of generated content on the User's website.
- Ranking monitoring – tracking keyword positions in Google search results.
- Keyword analysis – tools for researching and clustering keywords.
- Client Panel – a dedicated interface for managing SEO strategy, viewing reports, and content history.
- The Service Provider will make every effort to keep the Service available 24/7, but does not guarantee uninterrupted access and is not liable for technical outages resulting from infrastructure failures or maintenance work.
§ 6. User Obligations
- The User agrees to use the Service in accordance with applicable law, these Terms, and good practice.
- Using the Service is prohibited for the purpose of:
- generating content that infringes the copyrights or personal rights of third parties,
- creating unlawful content, including offensive, discriminatory, or misleading content,
- activities intended to disrupt the operation of the Service or its infrastructure.
- The User acknowledges that AI-generated content may contain errors or inaccuracies. It is the User's responsibility to verify generated content before publishing it.
- Ownership rights to content generated by the Service at the User's request belong to the User.
- The Service Provider reserves the right to anonymously use aggregated statistical data on Service usage for analytical and development purposes.
§ 7. Service Provider's Liability
- The Service Provider is not liable for:
- the consequences of SEO decisions made on the basis of the Service's recommendations,
- search engine rankings – the Service provides tools that support search ranking efforts but does not guarantee specific rankings,
- the factual accuracy of content generated by AI systems,
- interruptions to the Service resulting from causes beyond the Service Provider's control (infrastructure failures, force majeure),
- damages resulting from the User's breach of the rules for using the Service.
- The Service Provider's liability toward the User is limited to the total amount of fees paid by the User during the 3 months preceding the damaging event.
§ 8. Complaints
- Complaints regarding the services provided should be sent to: trafficly.kontakt@gmail.com.
- A complaint should include: the User's identifying details, a detailed description of the issue, and the expected resolution.
- The Service Provider handles complaints within 14 business days of receipt.
- A response to the complaint is sent to the e-mail address from which it was submitted.
§ 9. Termination of the Agreement
- The User may cancel the Subscription at any time from the Client Panel. Cancellation takes effect at the end of the current billing period – access to the services remains active until then.
- After the subscription period ends, access to paid features is blocked. The User's data is retained for 30 days, after which it may be permanently deleted.
- The User may request deletion of their Account and data at any time by sending a message to trafficly.kontakt@gmail.com.
- The Service Provider may terminate the agreement with 30 days' notice without stating a reason, or with immediate effect in the event of a serious breach of these Terms by the User.
- Fees paid in advance for an unused subscription period are non-refundable if the agreement is terminated due to the User's fault.
§ 10. Personal Data Protection
The rules for processing Users' personal data are set out in the Privacy Policy, available at trafficly.pl/polityka-prywatnosci, which forms an integral part of these Terms.
§ 11. Final Provisions
- These Terms are governed by Polish law.
- Any disputes arising from use of the Service will be resolved by the court with jurisdiction over the Service Provider's registered seat.
- In matters not regulated by these Terms, the provisions of the Polish Civil Code, the Act on Providing Services by Electronic Means, and the GDPR shall apply.
- These Terms take effect on June 1, 2025. The current version is always available at trafficly.pl/regulamin.
